Therefore, ISM advises you to refrain from using ISM’s Website and Services if at any point you think these Terms and Conditions of Service cannot be accepted from your side. ISM’s Terms and Conditions of Service applies to the Services provided through ISM’s Website, mobile applications, or software provided by ISM. 1. Information about us
This Website provides information about ISM Italia srl (ISM). Consulting services (“Speak with an expert”) can be purchased via this Website. No physical goods or shippable products are offered via this Website.

Unless otherwise indicated in these Terms and Conditions of Services, the following definitions shall apply:

- “User” means an account created via the ISM Website. ISM reserves the right to approve or reject a user account or revoke an account that was previously approved, without prior notice.
- “Online Services“ only refer to services that can be purchased via the ISM Website, such as “Speak with an expert”

ISM will make any possible effort to limit any downtime, however ISM reserves the right to withdraw or amend the Services provided on the Website without notice. ISM will not be liable if for any reason the Website is unavailable at any time or for any period.

ISM aims to update the Website regularly, and may change the content at any time. If the need arises, ISM may suspend access to the Website, or close it indefinitely. In accordance with ISM’s Privacy Policy, any information or technology shared by the Client and necessary to enable ISM to deliver the services (i.e. consultancy sessions) will be taken under ISM’s custody and not shared with third Parties except ISM’s partners that may be required for delivering the Services.

A User Account may be created when the User purchases one of the ISM Services available on the Website such as Consulting services (“Speak with an expert”). ISM reserves the right to approve or reject a user account or revoke an account that was previously approved, without prior notice. ISM services are not available to minors of 18 years old.
10. Viruses, Hacking and Other Offences
You must not misuse ISM’s Website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to ISM’s Website, the server on which our site is stored or any server, computer or database connected to our site. You must not attack ISM’s Website via a denial-of-service attack or a distributed denial-of service attack.
By breaching this provision, you would commit a criminal offence. ISM will report any such breach to the relevant law enforcement authorities and ISM will cooperate with authorities by disclosing your identity to them. ISM shall not be liable to the Client for any loss of revenue or profit or any indirect, special or consequential loss or damage, costs, expenses or other claims arising out of or in connection with services as well as digital contents purchased via this Website. In no event shall ISM be liable for any direct, indirect, punitive, incidental, special consequential damages, personal injury, life injury or damage to property, whatsoever arising out of or connected with the use or misuse of services as well as digital contents purchased via this Website.
13. Changes to FAQs
The FAQ page provides general guidelines on MOQ (Minimum Order Quantity), Lead Times, Product Pricing, Packaging, etc. These numbers are to be considered estimations and may be subject to change once an ISM Customer Representatives learns more about the Client’s project. Only then ISM can provide a more accurate quotation. ISM reserves the right to change the figures contained in the FAQ page at any time and without prior notice.
14. Refund and Return Policy
The services that can be purchased on the ISM Website (e.g. “Speak with an expert”) are subject to the following policies:
- You have the option to request a full refund of the amount paid for the Online services if you request it in writing; using the Contact Us page within 5 business days from the purchase date. The refund will be processed after ISM’s acknowledgement of the refund request.
- All Consulting Services must be used within 4 months from the date of purchase.
- Refunds cannot be requested in any case if ISM has already delivered the Online services (in full or partially).
15. Applicable law, Court of jurisdiction
These terms & conditions are governed in accordance with Italian law. Any dispute arising between the parties shall be dealt with exclusively in the courts of Italy.
16. Force Majeure
ISM will not be responsible in any manner for any loss or damage occurring as a result of forces beyond its control, including, without limitation, natural catastrophe, war, pestilence, labor dispute, telecommunications disruption, or any other matter, cause or thing which such parties do not directly control.
17. TradeMarks
ISM, italianshoemanufacturers.com, the ISM logo, all images and text, and all page headers, custom graphics and button icons are service marks, trademarks and/or trade dress of ISM. All other trademarks, product names and company names or logos cited herein are the property of their respective owners.
18. Images & Illustrations
Every effort has been made to locate the owners of copyrighted material, or their heirs or assigns, to seek permission to reproduce those images whose copyright does not reside with ISM Italia srl. We are grateful to the individuals and institutions who have assisted in this task. Any omissions are entirely unintentional and we would be grateful for any information that would allow us to correct any errors or omissions.
